These capital credits will be forfeited if not claimed by November 1, 2012.
Clear Creek’s Board of Directors previously authorized payment of a portion of capital credits earned in 1989 and 2006. Most of the authorized capital credits were paid to members, however attempts to find some members to make payment were unsuccessful. By law, Clear Creek’s Board of Directors has now authorized the forfeiture of all capital credit distributions that have remained unclaimed for more than four years after the date of distribution. The date of forfeiture is November 1, 2012. Former members must respond prior to November 1, 2012 to receive moneys owed. The board has taken this action as outlined in our Bylaws and the Oregon Revised Statue 62.425.
Every possible effort is being made to ensure that each member receives the money to which they are entitled. We attempt to locate former members by sending letters to their last known address. However, we may not have been notified of address changes and our notice may not have reached members when the capital credits were first available for payment. Notices are also printed in local newspapers and in our newsletter, Clear Lines.
